Swain County Court System
North Carolina's General Court of Justice has the Appellate Division, Superior Court Division, and District Court Division. Swain County Clerk Records
The Clerk of Superior Court is the court-records office. The clerk maintains criminal, civil, special proceeding, estates, judgments, liens, and related case files under the statewide Judicial Branch. The Register of Deeds is separate and handles land records, marriage licenses, marriage certificates, birth and death certificates, and recorded instruments. This difference matters because a marriage certificate request does not go to the same records counter as a divorce judgment, and a deed search is not a court case search.

Swain County Court Access Laws

Public records requests are different from ordinary case-file requests. Restricted Swain County Records
Not every Swain County record is public. Juvenile delinquency and undisciplined matters are restricted under Chapter 7B Article 30. Adoption records are confidential. Mental health and commitment proceedings contain protected medical and personal information. Sealed and expunged records are removed from ordinary public access, and public search tools should not treat them like standard adult case files.

The official sheriff page lists Brian Kirkland as sheriff, gives the office and jail phone as (828) 488-0159, and states that the new jail houses up to 109 inmates. No official county-hosted online jail roster was located in the research. State prison, probation, and parole records use the NC Department of Adult Correction offender search. That state search does not include county jail records. Swain County Traffic Records
Traffic citations in Swain County generally route through District Court. The official traffic help topic says traffic tickets are handled by a prosecutor, and trials or pleas of guilty or responsible are heard by a District Court judge. In smaller counties, traffic matters may be scheduled alongside criminal and misdemeanor matters, so the local calendar is important. The Swain payment page allows mail, in-person, and online payment for eligible cases, but some citations require a court appearance.
A court traffic record is not the same as an NCDMV driver record. Swain County Court History
Swain County was formed in 1871 from Jackson and Macon counties, with Bryson City as the county seat. The former courthouse in downtown Bryson City is now connected with the Swain County Heritage Museum, while current court filings and records are at the Mitchell Street courthouse.
